Tips For Answering Violations |
Important Information about Your
Facility Inspection
The accompanying Notice of Violation letter provides the results of your facility
inspection. This document is to assist you in reviewing and answering the
violation report in a timely manner.
The Radiation Protection Section has classified each violation into one of four
category levels: Level I, Level II, Level III and Level IV. A Level I violation indicates a critical health
and safety issue to the workforce staff, public and/or patient. All other
category level violations indicate a significant health and safety issue to the
workforce staff, public and/or patient but are not considered critical.
The severity level of the Notice of Violation is equivalent to the highest level violation issued for the inspection. The category level determines how your facility should respond to the violation. Identical violations found during two consecutive inspections are identified as repeats. A repeat violation will increase the category level of the violation to next level of severity.
If
you received a (Level 1) Notice of Violation which is a Critical Public Health
and Safety Violation:
Because these Severity Level I violations are considered critical public health and safety issues they are significant health and safety issues and must be answered within 15 business days from the date of the Notice of Violation. This does not mean the violation(s) must be corrected within 15 days. It is required that correspondence address the violation(s) listed in the accompanying Notice of Violation letter and include:
• facility registration number
• listing of proposed corrective action(s) to be taken to correct the problem(s) or listing of completed corrective action(s)
• name of Service Company who did or will perform any corrective action
• date that each corrective action was or will be completed
• upon completion, copies of service records and/or other supporting documents showing any corrective |action taken
• signature of the person who is legally responsible for the unit
If
you received a (Level II, III, IV) Notice of Violation:
Because these Severity Level violations are significant public health and
safety issues and must be answered within 30 business days from the date of the
Notice of Violation. It is required that any correspondence address the
violation(s) listed in the accompanying Notice of Violation letter and include:
• facility registration number
• listing of proposed corrective action(s) to be taken to correct the problem(s) or listing of completed corrective action(s)
• if all specified corrective actions are not completed within the response period, a report should nonetheless be provided to Radiation Protection Section
listing the corrective action(s) already taken and the schedule for completing the remainder of the corrective action(s), along with the supporting
documents.
• name of Service Company who will perform any corrective action
• date that each corrective action was or will be completed
• upon completion, copies of service records and/or other supporting documents showing any corrective action taken
• signature of the person who is legally
responsible for the unit
If you received a Recommendations Report:
Recommendations for your facility are attached and should be carefully reviewed. Implementation of these recommendations would strengthen your radiation protection program. No response is required for the items listed on the Recommendations Report.
